Le fait, pour tout client, de passer commande sur site www.sagilparis.com, implique son acceptation sans réserve des présentes conditions générales de vente. Toutes commandes passées sont destinées à l’usage personnel des clients. Les clients s’interdisent toute revente partielle ou totale des produits. Si une condition venait à faire défaut, elle serait considérée être régie par les usages en vigueur dans le secteur de la vente.

1 - Products

Customers are informed on the website of the essential characteristics of the products for table and interior decoration. It is reminded that the photographs illustrating, in support of the text, the products, do not enter into the contractual field. Also, if errors have been made, SAGIL cannot be held responsible.
No customer claim will be accepted if an article is unavailable.

2 - Prices

The prices are indicated in euros (all taxes included). SAGIL reserves the right to modify its prices at any time without prior notice, knowing that the items will be invoiced on the basis in force at the time the order is registered. Full payment must be made at the time of ordering. At no time can the sums paid be considered as a deposit or advance payment.
These prices are applicable in the context of distance selling. They can in no case be the subject of a request for application in store (and vice versa).
An invoice, serving as a guarantee if necessary, is sent for each order. Our prices are guaranteed subject to typographical or obvious printing errors.

3 - Terms of payment

The products and shipping costs are payable with the order.
You can pay for your purchases by credit card, Visa or Mastercard (secure online payment), by check or bank transfer.
Payment by credit card: on our site, all data is immediately encrypted in SSL mode. This information is known only to BRED computers followed by the BRED bank's highly secure system (3D Secure) to contact the customer's bank. At no time can SAGIL or any person on the Web view your card number. Your card will be debited the day after validation. Your order will be validated after acceptance of the payment.

4 - Participation in shipping costs

The countries of delivery are as follows: Metropolitan France (Corsica, French Overseas Departments and Territories, Europe and foreign countries) Customers must contact us to find out the price.

The contribution to shipping costs will be calculated on the final order. An increase in the contribution to shipping costs may be added to certain items due to their particular dimensions or special conditions of routing required, resulting in significant additional costs of special transport costs.

The customer acknowledges being fully informed of the contribution to shipping costs which is added to the price of the goods ordered.

5 - Confirmation of the order to the customer

SAGIL will send an order confirmation to the customer by E-mail upon receipt of the order.
The customer's order is considered accepted only after its validation by SAGIL.

6 - Delivery

Deliveries are made either : To the address indicated by the customer (excluding Sundays and public holidays). Our carriers (UPS, CHRONOPOST and others) are mandated for the delivery of the packages.
In the case of an order with several brands of products, this one could be carried out at once (by grouping the suppliers). Either: directly in the store, where the customer will have to collect the products (in this case, no shipping costs). A copy of the order form as well as an identity document will be requested as proof.

7 - Delivery delay:

SAGIL can not be held responsible for the consequences of any event beyond its control, including cases of force majeure or due to the carrier or manufacturer, which would tend to delay or prevent delivery of products ordered.
The delivery time can in no case result in the payment of damages to the customer.
In any event, this period is given for information only. In the event of a foreseeable extension of the delivery time mentioned on the order confirmation, SAGIL undertakes to inform the client as soon as possible and by any means so that the client can then choose to maintain his order.
In the event of failure to respect the delivery time mentioned on the order confirmation, the client can cancel it by sending a registered letter with acknowledgement of receipt to the following address: SAGIL - 242 RUE DE RIVOLI, 75001 - PARIS. Cancellation will only be taken into account by SAGIL if the shipment or delivery has not taken place between the sending and receipt of the said letter.

Conformity of the goods :
Upon receipt of the goods, you must carefully check the parcel(s) and verify the contents in the presence of the delivery man before signing the delivery slip.
If the products delivered have suffered damage during transport and are damaged (breakage, shock ....) you must refuse the parcel(s) by legibly writing the reason for your refusal on the delivery slip. The parcel(s) will be returned to us and you will be delivered again free of charge.
If there are quantities missing compared to what is written on the delivery slip, fill it in legibly by writing your reserves in a precise and detailed manner. Make a precise note of the number of packages and the designation of the missing products before signing the delivery slip. Confirm us through the contact form, section "contact", or call us, reminding us of the details of your order.

Attention:
as soon as you will have signed the delivery slip, without any precise reserve, the responsibilities of the carrier and SAGIL PARIS will be released. The mention "subject to unpacking" is not legal and cannot be retained. If the deliveryman does not give you time to check the goods, you must imperatively note on the delivery slip "Impossible to check the parcels because the driver is in a hurry and refuses to wait", in case of dispute, you will then have 48 hours to declare it by writing to the carrier by registered letter with A.R. (a copy must be sent to us).

In theabsence of precise reserves on the delivery note, the goods will be considered as delivered in conformity. Consequently, any complaint related to the state of the products cannot be received.

8 - Withdrawal period

En application de l’article L 121-16 du code de la consommation, le client dispose d’un délai de rétractation de sept jours à compter de la commande. Cependant dans le cas d’un ou voir plusieurs articles non disponible en magasin et ayant une nécessité à commander spécialement chez nos fabricants, aucun délai de rétractation et remboursement ne s’appliqueront.
Si le client use de ce droit de rétractation et que la livraison a déjà eu lieu, le retour des produits doit s’effectuer dans leur emballage d’origine, en parfait état, accompagnés de tous les accessoires et notices éventuels, au cas contraire, une décote pouvant aller jusqu’à trente pourcent (30%) sera appliquée.
Les articles retournés incomplets, abîmés, endommagés, utilisés ou salis ne pourront être repris.
Les frais de retour sont à la charge du client. SAGIL est tenu à l’échange des marchandises ou au remboursement des sommes versées par le client au titre des marchandises retournées, à l’exclusion des participations aux frais d’envoi. Le remboursement est dû dans un délai maximum de trente jours à compter de la réception du retour.
Le remboursement peut se faire par crédit sur le compte bancaire de la carte utilisée pour le règlement ou par chèque bancaire libellé à l’ordre du client.
Pour effectuer son retour, le client doit au préalable contacter nos services au
01 42 60 71 81 (du lundi au samedi de 9 h 30 à 18 h 30) ou envoyer un message par email à [email protected].

9 - Retention of title

The delivered products remain the property of SAGIL until full and effective payment of the price by the customer (effective collection of the payment by SAGIL).

10 - Completeness

In the event that one of the clauses of this contract is null and void by a change in legislation, regulation or a court decision, this shall in no way affect the validity and compliance with these general conditions of sale.

11 - Duration

The present conditions apply for the entire duration of the online services offered by SAGIL. They can be modified at any time by our company.

12 - Applicable law and jurisdiction

The present conditions are subject to French law.
Disputes arising from the application of the present general conditions of sale are subject to French law and only French courts can judge them.
Disputes between SAGIL and any customer are under the jurisdiction of the Commercial Court of Paris.

13 - Evidence

The final validation of the order will be worth proof of the completeness of the aforementioned order in accordance with the provisions of the law of March 13, 2000 and will be worth exigibility of the sums committed by the selection of the articles appearing on the purchase order.
This validation is worth signature and express acceptance of all the operations carried out on the site. The computerized registers, kept in the computer systems of the company SAGIL in reasonable conditions of security, will be considered as proof of communications, orders and payments between the parties.
The archiving of orders and invoices are made on a reliable and durable support so as to correspond to a faithful and durable copy in accordance with article 1348 of the Civil Code.

14 - Customer relations - Telephone advisers

For any question or difficulty encountered, the client can contact SAGIL by phone at 01 47 70 20 54 from Monday to Saturday from 10 am to 6 pm.
The client can, at any time, contact SAGIL through the "contact" section of the site.

15 - Declaration to the CNIL

In accordance with Law No. 2004-801 of 6 August 2004 on the protection of individuals with regard to the processing of personal data amending Law No. 78-17 of 6 January 1978, a declaration was made to the National Commission for Information Technology and Civil Liberties on 15 April 2009, relating to standard NS-48 and declared under number 135 87 35.
